The Malta Competition and Consumer Affairs Authority would like to remind importers of the applicable requirements concerning machinery and non-road mobile machinery (NRMM) placed on the Maltese market.
Under the Machinery Regulations, S.L. 427.36, transposing Directive 2006/42/EC, machinery falling within scope must satisfy the applicable essential health and safety requirements. Prior to being placed on the market or put into service, the applicable conformity assessment procedure must be carried out, the relevant technical documentation must be available, an EC Declaration of Conformity must be drawn up and the CE marking must be affixed, as applicable. These requirements also apply, where relevant, to machinery mounted on vehicles. Examples include truck- or vehicle-mounted cranes, furniture lifts, vehicle-mounted mobile elevating work platforms (high-ups), cherry pickers, tail lifts, refuse collector, concrete pumps and similar machinery mounted on road vehicles.
In addition, Regulation (EU) 2016/1628, transposed under Regulation S.L. 427.85, applies to internal combustion engines installed or intended to be installed in NRMM falling within its scope. Where applicable, such engines must comply with the relevant Stage V emission requirements and be covered by the relevant EU type-approval.Examples of NRMM include excavators, wheel loaders, skid-steer loaders, backhoe loaders, bulldozers, road rollers, mobile generators, pavers, forklifts and similar mobile machinery. Stage V requirements apply to the internal combustion engine where that engine falls within the scope of Regulation (EU) 2016/1628.
For future imports and orders, economic operators are to ensure, before the machinery is placed on the market, that the machinery complies with the applicable Machinery Regulations, bears the required CE marking and is accompanied by the relevant EC Declaration of Conformity and supporting documentation. Where an internal combustion engine falls within the scope of Regulation (EU) 2016/1628, the engine must also comply with the applicable Stage V requirements and be covered by the relevant EU type-approval.
With regard to machinery currently in stock or already ordered, as well as vehicle-mounted machinery which has already been registered but has not yet been sold, kindly complete the attached template. The template requests, amongst other information, the category and type of machinery, make and model, serial or chassis number, year of manufacture, whether new or second-hand, whether in stock, already ordered or, in the case of vehicle-mounted machinery, already registered but not yet sold, CE marking status, EC Declaration of Conformity details and, where applicable, engine details, NRMM emission stage and EU type-approval information.
For the purpose of this review, together with the completed template, kindly provide a corresponding inspection report issued by a warranted engineer, clearly identifying or making reference to the relevant equipment listed in the template. Where such a report or certificate has not yet been issued, the equipment must nevertheless be included in the template and this should be indicated accordingly. In the case of vehicle-mounted machinery which has already been registered but has not yet been sold, the same procedure involving a warranted engineer shall also apply.
Please note that an engineer’s report will be considered as supporting information for the Authority’s assessment and does not replace any applicable CE marking, conformity assessment, EC Declaration of Conformity or EU type-approval / Stage V requirements where these are legally applicable.
You are kindly requested to return the completed template, together with the relevant supporting documentation, by 30 October 2026. Should you currently have no machinery falling within the above categories in stock or already ordered by the end of 17 September 2026, and no vehicle-mounted machinery already registered but not yet sold, kindly confirm this in writing.
