Regulation (EU) 2026/405 establishes a modernised EU framework for detergents and surfactants, replacing Regulation (EC) No 648/2004. It aims to enhance protection of human health and the environment, improve transparency for consumers, and reflect the technological and market developments in the detergents sector.
The Regulation entered into force in March 2026 and will apply from 23 September 2029, with transitional periods for products already on the market.
Scope and Objectives
The Regulation applies to all detergents and surfactants placed on the EU market, including those used by consumers and professionals. It covers manufacturers, importers, distributors and refill operators.
Its main objectives are to:
- Improve consumer safety and environmental protection;
- Increase transparency and traceability of products;
- Support innovation and sustainability, including circular economy practices.
Key New Elements Introduced
The revised Regulation introduces several important changes compared to the previous framework:
- Digital Product Passport (DPP)
This is a new digital system providing comprehensive product information (e.g. ingredients, safety, compliance, traceability). It should be accessible via technologies such as QR codes or similar tools. The DPP is meant to enhance market surveillance and transparency for authorities and consumers.
- Digital Labelling
Certain information may be provided digitally, reducing label clutter. Essential safety information must still remain on physical labels.
- Expanded Scope (New Product Types)
Broader definition of detergents now includes:
- Products containing microorganisms.
- Products sold via refill systems.
- New types of cleaning products not previously covered.
- Regulation of Microorganisms
First-time inclusion of detergents containing live microorganisms (e.g. probiotic cleaners). It requires specific safety assessments, identification, and risk evaluation.
- Ban on Animal Testing
General prohibition on animal testing for detergents and their ingredients, with limited exceptions.
- Enhanced Biodegradability Requirements
Extends biodegradability rules beyond surfactants to:
- Polymeric capsule films.
- Other organic ingredients (phased in over time).
- Strengthens environmental protection requirements.
- Ingredient Data and Transparency
Before placing on the market detergents or end-user surfactants which are mixtures for which there is no obligation to provide information in accordance with Article 45 of Regulation (EC) No 1272/2008, the manufacturers/authorised representatives/importers/distributors established within the Union shall provide to the bodies appointed by Member States in accordance with that Article the ingredient data sheet referred to in point 2.2 (e) of Annex IV to Regulation (EU) 2026/405 (the ‘ingredients data sheet’). Where the detergent or end-user surfactant for which an ingredients data sheet has already been submitted no longer corresponds to the information included in that ingredients data sheet, the manufacturers/authorised representatives/importers/distributors shall submit an updated ingredients data sheet.
The ingredients data sheet shall be submitted by electronic means in the format provided by the European Chemicals Agency (ECHA) and made available free of charge for notifications in accordance with Part A, Section 3.1, second paragraph, of Annex VIII to Regulation (EC) No 1272/2008. The submission shall be in a language easily understood by the appointed bodies, as determined by the Member State in which the product is made available on the market.
- New Rules on Refill Systems
The revised regulation establishes requirements for detergents sold through refill stations, ensuring safety and information availability.
- Updated Labelling Requirements
Clearer and harmonised rules, including:
- Product identification (e.g. UFI code).
- Supplier contact details.
- Traceability information.
- Environmental Restrictions
Updated limits on phosphorus content in certain detergents.
Key Obligations for Economic Operators
Businesses placing detergents on the market must:
- Ensure compliance with updated composition and biodegradability rules.
- Provide accurate labelling and digital information.
- Submit required data (e.g. Ingredient Data Sheet).
- Guarantee product safety, including for new ingredients or microorganisms.
- Appoint an EU-based representative if established outside the EU.
Transition Period
The Regulation applies from 23 September 2029. Products compliant with the previous Regulation may continue to be sold under transitional provisions.
