{"id":3453,"date":"2026-06-09T15:08:54","date_gmt":"2026-06-09T15:08:54","guid":{"rendered":"https:\/\/mccaa.org.mt\/?post_type=trd-sub-page&#038;p=3453"},"modified":"2026-07-09T14:25:01","modified_gmt":"2026-07-09T12:25:01","slug":"e-cigarettes","status":"publish","type":"trd-sub-page","link":"https:\/\/mccaa.org.mt\/mt\/trd-sub-page\/e-cigarettes\/","title":{"rendered":"E-Cigarettes"},"content":{"rendered":"\n<ul class=\"wp-block-list\">\n<li>As things stand e\u2010cigarettes cannot be presented as a remedy to get rid of nicotine addiction \u2013 it is just another way of smoking \u2013 unless manufacturers decide to manufacture according to all the provisions of the&nbsp;<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:01993L0042-20071011\">Medical Device Directive 93\/42\/EEC<\/a>.<\/li>\n\n\n\n<li>Unless the e\u2010cigarette device is not used to deliver a medicinal intended to get rid of nicotine addiction it cannot be considered as a medical device. If a manufacturer decides to market e\u2010cigarette devices and e\u2010liquids as a way to get rid of nicotine addiction compliance to&nbsp;<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/en\/ALL\/?uri=CELEX%3A32001L0083\">Directive 2001\/83<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:01993L0042-20071011\">Medical Device Directive 93\/42\/EEC<\/a>&nbsp;would be necessary \u2013 that would mean presenting data showing the doses of nicotine delivered to the blood etc.<\/li>\n\n\n\n<li>Without prejudice to other legislation, the placing on the market of e\u2010cigarettes falls under the&nbsp;<a href=\"https:\/\/legislation.mt\/eli\/ln\/2010\/22\/eng\/pdf\">Tobacco (Smoking) Control Act (Legal notice 22 of 2010)<\/a>&nbsp;and the&nbsp;<a href=\"https:\/\/legislation.mt\/eli\/act\/2001\/5\/eng\/pdf\">Product Safety Act<\/a>.<\/li>\n\n\n\n<li>As regards the e\u2010liquids \u2013 there is currently no clear definition of what constitutes a danger to the health and safety of consumers. The LD50 of nicotine is 50 mg\/kg for rats and 3 mg\/kg for mice. 30\u201360 mg (0.5\u20131.0 mg\/kg) can be a lethal dosage for adult humans. A normal cigarette has 0.9 mg of nicotine.<\/li>\n\n\n\n<li>The most feasible and reasonable action would be to advise consumers that they smoke \u2013 whatever they \u2018smoke\u2019 \u2013 at their own risk<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Regarding labels on Liquids and Batteries please refer to the below:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1. E\u2010liquids: According to the harmonized classification found in&nbsp;<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=celex:32008R1272\">Annex VI of the CLP Regulation (EC) No 1272\/2008<\/a>, nicotine is a hazardous substance.&nbsp;&nbsp;Thus, the E\u2010liquids containing nicotine should be labelled according to the Dangerous Preparations Directive 1999\/45\/EEC until 01\u201006\u20102015 or the&nbsp;<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/en\/TXT\/?uri=CELEX:32008R1272\">CLP (EC) Regulation No. 1272\/2008<\/a>.&nbsp;&nbsp;As per legislation the label shall include the following information:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The name, address and telephone number of the supplier&nbsp; &nbsp;<\/li>\n\n\n\n<li>The nominal quantity of a substance or mixture in the packages made available to the general public (unless this quantity is specified elsewhere on the package)<\/li>\n\n\n\n<li>Product identifiers \u2013 chemical name and identification no. (e.g. CAS, EC)<\/li>\n\n\n\n<li>Where applicable, hazard pictograms, signal words, risk phrases (hazard statements), safety phrases (precautionary statements) and supplemental information required by other legislation.&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">2. Batteries:&nbsp;&nbsp;According to the&nbsp;<a href=\"https:\/\/legislation.mt\/eli\/ln\/2007\/311\/eng\/pdf\">Batteries and Accumulators Regulations, 2007 (Legal Notice 311 of 2007)<\/a>, accumulators and battery packs shall be appropriately marked with the symbol shown hereunder.&nbsp;&nbsp;The symbol indicating \u201cseparate collection\u201d for all batteries, accumulators and battery packs shall be the crossed\u2010out wheeled bin.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition to this symbol, if the batteries, accumulators and button cells contain more than a given amount of these metals&nbsp; \u2010&nbsp;0.0005 % mercury (Hg), 0.002 % cadmium (Cd) and 0.004 % lead (Pb)&nbsp; \u2010&nbsp; the crossed\u2010out wheeled bin should be accompanied by a chemical symbol (Hg, Cd, Pb).&nbsp;&nbsp;In other words, the chemical symbol always accompanies the crossed\u2010out wheeled bin, never as a stand\u2010alone label.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CE Mark and Declaration of Conformity (DoC) on the Electric \/ Electronic product parts. Besides the CE Mark displayed on the product part\/s where applicable, a complete DoC containing the elements according to applicable Directives is demanded. Typical Directives that may be applicable are: &nbsp;&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Low Voltage Directive<\/li>\n\n\n\n<li>EMC Directive<\/li>\n\n\n\n<li>RoHS Directive<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The manufacturer needs to be aware of the content stated on a Declaration of Conformity. With reference to MCCAA, giving information on how to fill and\/ or complete a Declaration of Conformity is considered consultancy.
