The proposed provisions transpose Commission Delegated Directives (EU) 2023/1437 and 2023/1526 by amending Schedule IV and Schedule VIII of the Restriction of Use of Hazardous Substances in Electrical and Electronic Equipment Regulations (S.L. 427.57), thereby providing for the following exemptions:
an exemption for the use of mercury in melt pressure transducers for capillary rheometers under certain conditions, for a limited validity period until 31 December 2025; and
an exemption for the use of lead as a thermal stabilizer in polyvinyl chloride used as base material in sensors used in in vitro diagnostic medical devices, for a limited validity period until 31 December 2023.
The aforementioned exemptions allow for the use of certain substances in electrical and electronic equipment for a limited period of time, where the substitution and, or elimination of such substances is technically or scientifically impractical. The proposed short term exemption extensions have not been considered as having a detrimental effect on the environmental and health protection.
