In terms of regulation 5(4) of the Control of Concentrations Regulations, 2002 published in Legal Notice 294 of 2002, the Director General of the Office for Competition notifies for general information that a notification of a proposed concentration between Lidl Immobiliare Malta Limited (Naxxar, Malta), Lidl Malta Limited (Naxxar, Malta), Said Investments Limited (Birkirkara, Malta) and Scotts Limited (Birkirkara, Malta) was deemed complete on Tuesday, 14 November 2023.

The proposed concentration is the acquisition by Lidl Immobiliare Malta Limited (Acquirer) of properties at Żabbar belonging to Said Investments Limited (Vendor) and leases belonging to Scotts Limited (Tenant). The Żabbar properties constitute the complex in Triq il-Mina ta’ Hompesch in Ħaż-Żabbar which comprises the building used as a supermarket known as Scotts, and the divided portion of land used as a parking area of the Żabbar supermarket. The intention of the acquirer is to lease out the Żabbar properties to Lidl Malta Limited to operate a ‘Lidl’ supermarket.

Lidl Immobiliare Malta Limited and Said investment Limited are both property companies, that acquire immovable property in Malta and are the operator and administrator of the business that they have acquired. Lidl Malta Limited and Scotts Limited are limited liability companies, both acting as an importer and retailer of finished and packaged products relating to food, beverages, allied products, and household items.

The Director General of the Office for Competition invites interested third parties to submit their views by not later than Friday, 24 November 2023.
