Energy labelling: New obligation

 

Energy labelling: New obligation as from 1st January 2019 applicable to Importers, Authorised Representatives and Manufacturers of Energy related products.

The MCCAA would like to remind Suppliers (Manufacturers, the Authorised Representative of a manufacturer who is not established in the Union, and Importers who import energy products from outside the EU) of their obligations to comply with the requirements of Regulation (EU) 2017/1369 on Energy Labelling. One of the Supplier’s obligations is that of registering their energy models in the Commission’s Product Database. Deadlines are stipulated as follows:

As from 1 January 2019, Suppliers shall ensure that before a new model is placed on the market covered by a delegated act, insert in the product database the information for that model, as per Annex I of the Regulation. Models placed on the market between 1 August 2017 and 1 January 2019, covered by a delegated act, the supplier shall, by 30 June 2019, insert in the product database the information set out in Annex I in relation to those models.

Important definitions are provided under Article 2 of the Regulation. Nevertheless, for ease of reference the definitions of Manufacturer, Importer and Supplier can be found below:

‘Manufacturer’ means a natural or legal person who manufactures a product or has a product designed or manufactured, and markets that product under its name or trademark;

‘Importer’ means a natural or legal person established in the Union who places a product from a third country on the Union market;

‘Supplier’ means a manufacturer established in the Union, the authorised representative of a manufacturer who is not established in the Union, or an importer, who places a product on the Union market;

This regulation has been enacted in national legislation under the Product Safety Act, S.L. 427.96.
